im pretty confident that were *i* the supreme court nominee and made such a statement, id have no chance in hell of being confirmed. in fact, id prolly be run out of the country on a rail.

so how is it that sotomayor can be a straight-up admitted racist (supported by her record on the bench) and get nominated to the highest court in the land? how is it that a judge who is on record stating that the role of the circuit court judges is to make policy and legislate from the bench gets nominated to a position that is obligated specifically NOT to make policy or rule based on "empathy" but solely upon the text of the constitution?

i have a feeling im about to have another one of those "filled-with-HORROR-and-disbelief" moments over sotomayor, one like when the messiah won, and again when he was actually inaugurated... and again when he nationalized a major auto manufacturer... and again when... oh hell, i ought to be used to it by now, right?
